Understanding the Indian Arts & Crafts Act for Native Artists

The Indian Arts and Crafts Act of 1990 is a truth-in-advertising law that prohibits misrepresentation in the marketing of Native and American Indian art and craft products within the United States. Under the Act, an Indian is defined as a member of any federally or officially State recognized tribe of the United States, or an individual certified as an Indian artisan by an Indian tribe.

How can this law help you, and what do you need to do to stay on the right side of it? Register to find out.

Participants must register here.

Online Artist Entrepreneur Training

Native American artists face unique challenges today, with the shift to online sales and continued limits on attendance at local arts and crafts fairs where their work has traditionally found a home. Register now for this inaugural program of a free, monthly, webinar series that will run through December 2022.

Designed to help Native American visual artists develop and expand their e-commerce presence, the programs will feature speakers from private and public sectors who have extensive experience in these industries.

Session 1 - What you need to sell your arts and crafts online - an Introduction to Entrepreneurship for Native American visual artists and craftspeople

This initial program will focus on business basics:

  • introduction to entrepreneurship

  • developing a business plan

Upcoming sessions will explore such topics as :

  • an e-commerce primer

  • building a brand

  • pricing products and getting paid

  • protecting your arts and crafts

  • enforcing rights in an e-commerce environment

This program is presented by the Global Intellectual Property Academy, a unit of the USPTO’s Office of Policy and International Affairs. OPIA assists the Under Secretary of Commerce for Intellectual Property and Director of the USPTO in advising the President (through the Secretary of Commerce) and federal agencies on domestic and international IP issues as well as on U.S. treaty obligations. It also provides technical assistance and training on IP-related matters to U.S. stakeholders and both U.S. and foreign government officials.
